Employee representatives also play an important role in workplaces.
Where no workplace trade union operates, the Labour Code provides for consultations with employee representatives on specific matters.
These can concern, among other things:
- working time organization,
- remote work,
- occupational health and safety (BHP),
- specific changes in employment organization.
An employee representative should be genuinely elected by employees, not simply appointed by the employer.
Regulations do not specify a single, universal procedure for electing employee representatives. The election method should follow the rules adopted at the given employer.
A good election procedure should ensure:
- informing employees about the purpose of the election,
- informing employees about the representative’s powers,
- the possibility of nominating candidates,
- the opportunity for all eligible employees to participate,
- freedom of choice without employer pressure,
- documentation of the vote,
- defining the term of office or scope of matters for which the mandate is granted.
