Declaration

You need to be aware of several obligations that the Polish law imposes on employers hiring foreigners based on a declaration of entrusting work to a foreigner. If your declaration (details regarding the so-called “declaration procedure” can be found HERE) (po kliknięciu w „HERE” powinno być przekierowanie do odpowiedniej podstrony dot. oświadczeń) has been entered into the register of declarations, then:

    • within the contract with a foreigner, you must include the conditions specified in the declaration, such as the type of contract, position, working hours, amount of remuneration, etc.,
    • before allowing the foreigner to start work, you must submit a scan of the contract concluded with the foreigner to the authority that entered the declaration into the register (you do this via the IT system on the website www.praca.gov.pl);
    • you must provide this declaration to the foreigner;
    • you must inform the district governor who entered the declaration into the register that the foreigner has started work with you (within 7 days of starting work) or that the foreigner did not take up the work (within 14 days from the date specified in the declaration as the start date of work);
IMPORTANT! If, for objective reasons, the foreigner was unable to start work from the first days of the validity of the declaration (e.g., they were not able to obtain a visa and come to Poland that quickly), do not hesitate to submit a notification of not taking up work – this will not invalidate the declaration. As soon as the obstacle ceases (e.g., the foreigner obtains a visa and comes to Poland) – submit a notification of starting employment. By acting in this way, you will avoid a penalty for failing to fulfill your information obligation;  
    • you must inform the district governor who entered the declaration into the register that the foreigner will not take up work at all or has ended work before the date specified in the declaration as the end date of employment;

IMPORTANT! As a result of submitting such a notification, the entry of the declaration of entrusting work to the foreigner will be invalidated – neither you nor the foreigner will be able to use it.
