The rights of persons working in Poland—both under an employment contract and a contract of mandate—are protected by legal regulations, in particular the Labor Code and the Civil Code. Their purpose is to ensure fair, safe, and dignified working conditions. In practice, however, violations of these rights are unfortunately not a rare occuranceoccurrence, —affecting both full-time employees and contractors. We would like to present the most common examples of violations of the rights of people performing work, possible legal consequences for employers, and the available ways to pursue claims—regardless of the type of contract concluded.
The most common violations by employers—affecting both employees under employment contracts and contractors—primarily include irregularities related to contract termination, improper payment of wages, and incorrect granting of leave.
An employer who violates an employee’s rights exposes themselves to sanctions under the Labor Code, the Civil Code, and even the Criminal Code.
