Work permit

When employing a foreigner based on an issued work permit (details regarding the procedure for obtaining a work permit can be found HERE), (po kliknięciu w „HERE” powinno być przekierowanie do odpowiedniej podstrony dot. zezwoleń)  you must remember to fulfill several important obligations. If the competent voivode has issued you a work permit for a foreigner, then:

  • the contract must reflect the conditions specified in the permit, such as the type of contract, position, working hours, remuneration, etc.;
  • before allowing the foreigner to start work, you must submit a scan of the contract concluded with the foreigner to the voivode who issued the work permit (you do this via the IT system on the website www.praca.gov.pl);
  • you must provide the issued work permit to the foreigner;
  • you must inform the voivode of changes that do not require obtaining a new work permit (e.g., change of your company’s registered office, change of the job title without altering the scope of duties, etc.);
  • you must inform the voivode who issued the work permit that the foreigner has not started work with you within 2 months from the initial validity date of the permit, ended work earlier than 2 months before the expiration of its validity period, or interrupted work for a period exceeding 2 months. You send such a notification via the IT system on the website www.praca.gov.pl within 7 days of the occurrence of any of these three circumstances;

IMPORTANT! As a result of submitting one of the above notifications, the voivode who issued the work permit will revoke the permit – neither you nor the foreigner will be able to use it (e.g., for obtaining a visa and coming to Poland). However, there is an exception to this rule – if in the notification of failure to start work on time or of a break in employment you include an explanation regarding the reasons for not starting or interrupting work, and additionally submit a declaration that the permit will be used in accordance with its purpose, the voivode will not revoke the permit.,/div>
