Although the regulations do not provide for a formal classification of contracts of mandate, for better clarity they can be divided according to remuneration (paid and unpaid) and the duration of work (fixed-term and indefinite).
- A contract of mandate (umowa zlecenie) can be either paid or unpaid. If the parties agree that the contract is to be unpaid, this should be clearly stated in the content of the contract or be evident from the accompanying circumstances. If this is not specified, the contract is considered paid, and the contractor is entitled to remuneration. In a situation where the amount of remuneration is not specified, it is assumed that the person performing the mandate is entitled to compensation corresponding to the work performed.
- In terms of duration, a contract of mandate may be concluded for a fixed term or for an indefinite period. A contract of mandate for an indefinite period is an open-ended contract. It does not include an end date and remains in effect until, for example, it is terminated. A fixed-term contract of mandate includes a specific end date for the cooperation or completion of the task, as agreed upon by the parties.
