Work permit

If you run a business in Poland, or are an individual and want to employ a foreigner in Poland to whom none of the exemptions from the obligation to hold a work permit apply, you must obtain a work permit from the competent voivode before entrusting them with work.

INTERESTING FACT:
This permit used to be called the “Type A Permit.” Currently, the name is more complex — since June 2025, you will find it under the name “Work permit for a Polish entity entrusting work to a foreigner.”

This is the most common document legalizing the employment of foreigners in the territory of the Republic of Poland, which, unlike a declaration or notification, can be issued for any foreigner regardless of their nationality.

You submit the application for a work permit for a foreigner to the voivode competent for the registered office of your company or for your place of permanent residence as of the date of submitting the application.

IMPORTANT!
Before the amendment of the regulations in June 2025, you could submit an application for a work permit either electronically or in paper form (directly at the voivodeship office or by post). However, starting from June 1, 2025, such an application can be submitted only electronically via the electronic system (on the website praca.gov.pl – where there is a ready-made form that must be completed and signed, e.g. with ePUAP). Any application submitted in another form will not be processed.

When submitting an application for a work permit, you must attach an appropriate declaration of no criminal record (you complete a provided template) along with the necessary attachments. The detailed list of attachments will be specified in a regulation by the Minister responsible for labor (which, as of 06.09.2025, has not yet been issued); however, it will include, among others:

    • proof of payment of the stamp duty

      Until the new regulation of the Minister of Labor specifying the new fee rates has been issued, you must apply the “old” rates: PLN 50 (if the foreigner will be employed for less than 3 months) or PLN 100 (if you intend to employ the foreigner for a period exceeding 3 months),
    • documents relating to your business activity (e.g. extract from the National Court Register, extract from the Central Register and Information on Economic Activity, articles of association, etc.),
    • a scan of your valid identity document,
    • a scan of the foreigner’s valid travel document with personal data,
    • documents confirming that the candidate meets the qualification requirements and conditions necessary to perform the job (e.g. a scan of a driving license if the employee is to be employed as a driver, etc.).
    • your certificate confirming no arrears in paying taxes and social security contributions. If you, as the employer, have such arrears, you will be refused the issuance of a work permit for the foreigner. Therefore, it is advisable to verify your company’s situation in this regard in advance and prepare the necessary certificates,
    • confirmation of having sufficient financial resources/income sources necessary to cover obligations towards your future employee(s).

The decision regarding your application for a work permit should be issued within one month, but if the case turns out to be more complex – within two months.

IMPORTANT!
A condition for obtaining a work permit is that the foreign worker’s salary cannot be lower than the salary of employees performing comparable work, nor lower than the statutory minimum wage. Moreover, after the amendment of the law in June 2025, the foreign worker’s working time cannot be less than 1/4 of full-time employment and cannot exceed full-time employment.

After obtaining the permit, the so-called “foreign worker aspect” is taken care of – from then on, you proceed in the same way as with Polish employees.

REMEMBER!
The work performed by a foreigner should comply with the work permit (e.g., position, type of contract, place of work, remuneration, etc.), and as a rule, any change in working conditions should be preceded by a change or issuance of a new work permit. However, changing or issuing a new permit will not always be necessary. For example, in the case of changing your company’s registered office, the takeover of the workplace by another entity, or changing the job title (without changing the scope of the foreigner’s duties) — this will not be required.
